Terms & Conditions
D-Tech Driver Training | Practical Lessons, Cancellations & Test Day Car Hire
1. Driver Licences & Fitness to Drive
- Valid Licence Mandatory: The learner driver must carry and present a current, valid NSW Learner Driver Licence, interstate permit, or approved overseas licence at the start of every practical lesson. Both physical cards and digital licences via the official Service NSW app are accepted.
- Unlicensed / Suspended Driving: If a student cannot present a valid licence at the start of a lesson, the lesson cannot proceed by law, and the full lesson fee is forfeited.
- Zero Tolerance for Alcohol & Drugs: NSW road rules mandate a strict 0.00 Blood Alcohol Concentration (BAC) and zero presence of illicit drugs for all learner drivers. If an instructor suspects impairment by alcohol, illegal substances, or drowsy prescription medications, the session will be terminated immediately with full fee forfeiture.
- Corrective Lenses: If your licence condition requires corrective lenses ('Condition S'), appropriate glasses or contact lenses must be worn at all times while behind the wheel.
- Footwear: Enclosed, flat footwear must be worn during all lessons. Bare feet, thongs, slides, high heels, or heavy work boots are strictly prohibited for pedal safety.
2. Cancellations, Rescheduling & No-Shows
- 24-Hour Notice for Regular Lessons: A minimum of 24 hours' notice is required to cancel or reschedule a standard driving lesson without penalty.
- Late Cancellations: Cancellations or rescheduling requests made within 24 hours of the scheduled lesson start time will incur a cancellation fee equal to 100% of the scheduled lesson fee.
- 48-Hour Notice for Driving Test Packages: Because Service NSW test day packages reserve a 2.5 to 3-hour dedicated block, cancellations or changes to a test day booking require at least 48 hours' notice. Cancellations within 48 hours forfeit the full test package booking fee.
- Instructor Waiting Time & No-Shows: Your instructor will arrive at the agreed pick-up address at the scheduled time. If the learner does not appear and cannot be contacted after 15 minutes, the session will be marked as a no-show, the lesson will be cancelled, and 100% of the lesson fee will apply.
- Instructor Rescheduling: If D-Tech must reschedule a lesson due to severe weather warnings (e.g. flash flooding), mechanical inspection, or instructor illness, the lesson will be rescheduled to a mutually agreeable time at no additional charge.
3. Lesson Packages, Payments & Expiry
- Payment Terms: Pay-as-you-go lessons must be settled before or at the start of each lesson via cash, direct bank transfer, or card. Discounted multi-lesson bundles (including 6-hour and 10-hour packages) must be paid in full prior to or on the day of the first session.
- Package Validity: All prepaid lesson packages and gift vouchers remain valid for 12 months from the date of purchase and are non-transferable between individuals.
- Refund Policy: Prepaid lesson packages are non-refundable for change of mind. If exceptional circumstances warrant a refund on unused package hours, completed lessons will be recalculated at the full standard hourly rate ($70/hr), and any remaining balance refunded accordingly.
4. Service NSW Driving Test Day Package ($200)
- Package Inclusions: The $200 Test Day Package includes student pick-up, a 1-hour pre-test warm-up and route orientation drive, hire of our dual-control vehicle for the Service NSW testing officer evaluation, and drop-off after test completion.
- Vehicle Hire Discretion: The instructor reserves the right to withhold or withdraw the vehicle from being used for the driving test if the student’s driving during the 1-hour warm-up session is dangerous, reckless, or poses an immediate safety hazard to the public, the examiner, or the vehicle. In this situation, test package fees are non-refundable.
- Service NSW Administrative Fees & Cancellations: The package covers instructor time and vehicle hire only. Booking fees and licence issue fees charged directly by Service NSW are the sole responsibility of the candidate. If a test cannot proceed due to candidate logbook calculation errors, booking the wrong test, or Service NSW system rescheduling, the package fee remains payable.
5. Training Vehicles, Fines & Traffic Infringements
- Dual-Control Fleet Safety: Training is conducted in modern, ANCAP 5-star safety-rated dual-control vehicles fitted with passenger-side safety pedals and instructor auxiliary mirrors.
- Lessons in Student’s Own Car: The learner's initial lesson must be conducted in our dual-control vehicle to assess core competencies. Subsequent lessons in the student's personal vehicle may be permitted only if the car is currently registered, roadworthy, comprehensive insurance coverage is demonstrated, and L-plates are displayed.
- Traffic Offences & Camera Infringements: While our accredited instructors maintain vigilance and utilize dual controls, learner drivers remain legally accountable for vehicle control. Any statutory camera infringement (such as red-light cameras, mobile phone detection cameras, or deliberate speeding) resulting directly from learner non-compliance will be nominated to the learner driver as required under NSW road transport law.
- Mobile Devices: In accordance with NSW road rules, mobile phones and smart devices must not be touched, checked, or operated in any manner by the learner driver while the vehicle engine is running.
6. Transport for NSW 3-for-1 Logbook Hours
Under the Transport for NSW structured lesson scheme, every 1 hour of professional tuition with our accredited instructor records as 3 hours in your official learner logbook (up to a maximum of 10 professional hours, yielding 30 logbook credit hours). Any further driving lessons beyond 10 hours continue to be logged as 1 hour for each hour driven.
7. Parental & Guardian Guarantee (Learners Under 18)
Where a learner driver is aged 16 or 17 years old, the parent or legal guardian booking the lessons acts as a financial guarantor for all liabilities, booking agreements, cancellation fees, and obligations set out within these Terms and Conditions.
8. Limitation of Liability & Governing Law
To the maximum extent permitted by Australian Consumer Law, D-Tech Driver Training will provide services with due care and skill. These Terms and Conditions are governed exclusively by the laws of New South Wales (NSW), and all parties submit to the jurisdiction of the courts of NSW and the NSW Civil and Administrative Tribunal (NCAT).
